Terms of Service

EFFECTIVE DATE: 4/20/2025

These Terms of Service ("Terms") govern your access to and use of the HyeTech mobile application ("the App"). By downloading, accessing, or using the App, you ("Member," "you," or "your") agree to be bound by these Terms, including our Privacy Policy, which is incorporated into these Terms by reference.

1. ACCEPTANCE OF TERMS

By accessing or using the App, you agree to these Terms and the Privacy Policy. If you do not agree to these Terms, you must not use the App.

2. USER REGISTRATION

To use the features of the App, you must create a Google account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the confidentiality of your account information, including your password.
  • Maintain the confidentiality of other members' private information (as set forth in Section 1.2 of the Privacy Policy).
  • Notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account for unauthorized activity or violations of these Terms.

3. LICENSE TO USE THE APP

HyeTech grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

You may not:

  • Copy, modify, distribute, sell, lease, or exploit the App.
  • Reverse engineer or attempt to extract the App's source code.
  • Use the App in violation of applicable laws or third-party rights.
  • Scrape, extract, harvest, or index any data from the App using automated tools or manual processes.

4. USER CONTENT

You may upload or submit content to the App ("User Content"). You retain ownership of your User Content, but by submitting it, you grant HyeTech a worldwide, royalty-free, non-exclusive, sublicensable license to use, display, distribute, and modify the content within and outside the App, including for commercial purposes (such as advertising or promotional use, in compliance with our Privacy Policy).

You agree not to upload or share any content that:

  • You do not own or have appropriate licenses for (e.g., third-party copyrighted or trademarked material).
  • Is false, misleading, offensive, or illegal.
  • Violates any third-party rights or promotes illegal activities.

You are solely responsible for the User Content you submit.

5. APP USE AND CONDUCT

You agree to use the App in a respectful and lawful manner. You must not:

  • Harass, bully, or threaten other users.
  • Upload, discuss, or coordinate harmful or unlawful activities.
  • Interfere with the App's operation or security.
  • Upload content you do not have the legal right to use.

Violation of this section may result in immediate termination of your account.

6. PAYMENT AND FEES

The App may offer paid services. By purchasing any such services, you agree to pay all applicable fees and abide by the third-party payment processor's terms.

YOU AGREE TO INDEMNIFY HYETECH AGAINST ANY CLAIMS, LIABILITIES, OR LOSSES ARISING FROM THE USE OF ANY THIRD-PARTY PAYMENT SYSTEM.

7. INTELLECTUAL PROPERTY RIGHTS

All content, features, and functionality of the App, including text, graphics, logos, and software, are owned by HyeTech or its licensees and are protected by intellectual property laws.

You may not use any HyeTech trademarks or content without written permission.

8. DISCLAIMER OF WARRANTIES – "AS IS"

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

HyeTech does not warrant that the App will be error-free, uninterrupted, or secure.

9. LIMITATION OF LIABILITY

To the fullest extent allowed by law, HyeTech shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, personal injury, or device damage.

10. INDEMNIFICATION

You agree to indemnify and hold harmless HyeTech, its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the App.
  • Your User Content.
  • Your violation of these Terms.
  • Your use of third-party services such as payment processors.

11. TERMINATION

We may terminate or suspend your access to the App at any time without notice for any reason, including a breach of these Terms.

Upon termination, your license to use the App will end, and any associated data may be deleted subject to our data retention policies.

12. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. You agree that any dispute, claim, or legal proceeding arising out of or related to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, and you consent to the personal jurisdiction and venue of those courts.

13. COOKIES AND TRACKING TECHNOLOGIES

THE APP MAY USE COOKIES OR SIMILAR TECHNOLOGIES TO ENHANCE USER EXPERIENCE AND FUNCTIONALITY. BY USING THE APP, YOU CONSENT TO THE STORAGE AND USAGE OF SUCH TECHNOLOGIES ON YOUR DEVICE IN ACCORDANCE WITH OUR PRIVACY POLICY.

14. MISCELLANEOUS

  • Severability: If any provision of these Terms is deemed unenforceable, the remaining provisions remain in full effect.
  • Entire Agreement: These Terms and our Privacy Policy represent the full agreement between you and HyeTech.
  • Assignment: HyeTech may assign its rights and obligations under these Terms without restriction.
